Court of Appeals, State of Michigan
ORDER
IN RE T STRICKLAND-MILLER MINOR
Docket No. 378080
LC No. 21-050441-NA
Mark T. Boonstra, Judge, acting under MCR 7.211(E)(2) and MCR 7.216(A)(7), orders:
The motion for immediate consideration, including the requested relief that this Court order
“the trial court to prepare and provide transcripts for all trial court hearings that took place between the
filing of Respondent-Appellant’s last claim of appeal and the claim of appeal giving rise to the instant
matter,” is DENIED. Appellant was responsible for securing the filing of the transcript.
MCR 7.210(B)(1)(a). In a termination of parental rights appeal “where appellant is represented by
appointed counsel, the appellant’s attorney is expected to review the lower court file shortly after
appointment to ensure that the trial court has ordered all transcripts from the proper court reporter(s).
Appointed counsel must immediately order any necessary transcripts that were not included in the initial
order prepared by the trial court.” IOP 7.210(B)(1)-1 (emphasis added). Appellant’s counsel has not met
this obligation.
The motion for an extension of time to file appellant’s brief for this priority appeal is
DENIED.
On the Court’s own motion, this cause is REMANDED to the trial court for the
appointment of substitute counsel, current counsel having failed to timely order and secure the filing of
all transcripts for this appeal.
