Docket No. 376161

Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application for leave to appeal,
the Court VACATES IN PART the trial court’s December 10, 2024 order denying defendant’s successive
motion for relief from judgment insofar as the trial court rejected defendant’s sentencing arguments
involving Miller v Alabama, 567 US 460; 132 S Ct 2455; 183 L Ed 2d 407 (2012) and its progeny. The
Court REMANDS to the trial court for reconsideration of defendant’s sentencing arguments in light of
People v Eads, ___ Mich App ___; ___ NW3d ___ (2025) (Docket No. 357332), lv gtd 25 NW3d 118
(Mich, 2025). In all other respects, the delayed application for leave to appeal is DENIED because
defendant failed to establish that the trial court erred in denying the successive motion for relief from
judgment.
We do not retain jurisdiction.
