The motion to stay circuit court proceedings is DENIED.
Pursuant to MCR 7.205(E)(2), in lieu of granting the application for leave to appeal, the
trial court’s decision denying the motion to amend the complaint is PEREMPTORILY REVERSED. The
trial court abused its discretion by denying the motion because the proposed amendment would not result
in prejudice to the defense. See Weymers v Khera, 454 Mich 639, 659; 563 NW2d 647 (1997). The
February 26, 2025 order of the trial court is VACATED, and the case REMANDED for entry of an order
granting plaintiff leave to file the proposed amended complaint.
This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
