The motion for immediate consideration is GRANTED.
The motion for reconsideration is DENIED. However, insofar as defendant-appellee
requests clarification regarding this Court’s December 19, 2025 order, that request is GRANTED in part.
At the time we entered that prior order, the trial court had not yet ruled on the prosecution’s motion for
stay pending appeal in that court, which is ordinarily a prerequisite to obtaining a stay of the proceedings
below, pending appeal, from this Court. See MCR 7.209(A). But this Court’s December 19, 2025 order
granted the prosecution’s motion to waive the requirements of MCR 7.209(A), as expressly permitted
under IOP 7.209(A)(3). On that basis, it was appropriate for this Court to grant a stay of any further
“proceedings” below—including the bond hearing that was then scheduled—pending further order of this
Court or a final resolution of this appeal. See MCR 7.209(D) (“On its own initiative or on a party’s
motion, the Court of Appeals may stay proceedings in the trial court or stay the effect or enforcement of
any judgment or order of a trial court on the terms it deems just.”); IOP 7.205(F) (“All parties should be
aware that the Court may issue an immediate ruling granting stay pending further review and order of the
Court, and then issue a final ruling after a full review . . . . This type of order will preserve the status quo
while the Court more fully considers the matter.”).
