The motion for immediate consideration is GRANTED.
On the Court’s own motion, and in accordance with MCR 7.216(A)(4) and (9), the Court
orders that defendant-appellant’s motion for partial peremptory reversal is HELD IN ABEYANCE
pending further order of this Court. Because the prosecution has acknowledged in their appellee’s brief
that defendant is entitled to 56 additional days of sentence credit, this matter is REMANDED to the Kent
Circuit Court. MCR 7.208(A)(1). On remand, and within 7 days of the date of this order, the parties shall
file with the circuit court a stipulation to amend the judgment of sentence to reflect the correct amount of
sentence credit to which defendant-appellant is entitled. MCL 7.208(A)(2). Upon receipt of the
stipulation, the circuit court shall reconsider whether defendant-appellant is entitled to an additional
56 days of sentence credit. Defendant-appellant shall file with this Court a copy of the order or amended
judgment that resolves this matter on remand within 7 days of its entry.
This Court retains jurisdiction. This order has immediate effect. MCR 7.215(F)(2).
