Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V BRANDON LAWRENCE TATE
Docket No. 379004
LC No. 20-004217-01-FC
Brock A. Swartzle
Presiding Judge
Thomas C. Cameron
Christopher M. Trebilcock
Judges
The motion to waive fees is GRANTED for this case only.
The motion to remand is DENIED.
The delayed application for leave to appeal is DENIED because defendant has failed to
establish that the trial court erred in denying the motion for relief from judgment. As the appellant here,
defendant bears “the burden of furnishing . . . a record to verify the factual basis of any argument upon
which reversal [i]s predicated.” People v Elston, 462 Mich 751, 762; 614 NW2d 595 (2000). Defendant
did not provide any evidence to support his various claims of error—not even defendant’s own affidavit—
thus precluding appellate review at the outset of this application.
