This Court’s April 10, 2025 opinion and order remanded this case, while retaining
jurisdiction, to the trial court to articulate, in detail, the reasons for defendant’s upward-departing sentence.
Following the conclusion of the remand proceedings, this Court reviewed the May 21, 2025 remand
hearing transcript and the parties’ supplemental briefing and determined that the trial court again failed to
articulate sufficient justification for the extent of the departure from the sentencing guidelines and the 25-
year mandatory minimum under MCL 750.520b(2)(b). Therefore, on September 30, 2025, this Court
vacated defendant’s sentence and remanded this case to the trial court, while retaining jurisdiction, for
resentencing. On second remand, the trial court resentenced defendant to 25 to 60 years’ imprisonment
and entered a corresponding judgment of resentence.
The trial court having imposed the 25-year statutory minimum sentence on second remand,
and neither party having filed additional supplemental briefing, we AFFIRM the November 25, 2025
judgment of resentence. This appeal is now CONCLUDED.
