Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V COREY ALLEN DOTSON
Docket No. 377171
LC No. 06-011003-02-FC
Christopher M. Murray
Presiding Judge
Kristina Robinson Garrett
Kathleen A. Feeney
Judges
The delayed application for leave to appeal is DENIED because defendant has failed to
establish that the trial court erred in denying the successive motion for relief from judgment. Presuming
that the affidavits and evidentiary hearing testimony from Bennie Robinson and Antonio Payton amount
to new evidence that survives the procedural bar of MCR 6.502(G), considering this evidence along with
that presented at trial, defendant has not established that a different result is probable on retrial. See People
v Johnson, 502 Mich 541, 566-567, 571-572. Accordingly, the trial court correctly denied the successive
motion for relief from judgment.
