Pursuant to MCR 7.211(C)(4) and MCR 7.205(E)(2), and in lieu of granting the application
for leave to appeal, we VACATE in part the May 26, 2023 order of the trial court to the extent that it
imposed court costs and attorney fees on defendant.
The motion to remand is GRANTED and we REMAND for further proceedings consistent
with this order. On remand, the trial court shall explain on the record the factual basis for any court costs
and attorney fees. See People v Lewis, 503 Mich 162, 167-168; 926 NW2d 796 (2018); People v Goulder,
__ Mich App __, __; __ NW3d __ (2026) (Docket No. 373826), slip op at p. 6.
In all other respects the application is DENIED for lack of merit in the grounds presented.
The trial court shall render its decision on remand within 56 days of the Clerk’s certification
of this order. We do not retain jurisdiction.
