The motion for immediate consideration is GRANTED.
Pursuant to MCR 7.205(E)(2), and in lieu of granting the application for leave to appeal,
we VACATE the June 8, 2026 order of the trial court denying defendant’s motion to proceed in propria
persona and REMAND for further proceedings consistent with this order. The record does not support a
finding that “there is sufficient certainty of serious obstructionist misconduct,” People v Richards, 315
Mich App 564, 575 (2016), rev’d in part 501 Mich 921 (2017), or undue inconvenience and burden on the
court and the administration of the court’s business, People v Anderson, 398 Mich 361, 368 (1976). On
remand, the trial court must complete the inquiry required by Anderson, 398 Mich at 367-368, and MCR
6.005(D) and (E). People v King, 512 Mich 1, 11-12 (2023). Additionally, the trial court “may terminate
self-representation” if defendant “deliberately engages in serious and obstructionist misconduct,” and may
appoint standby counsel “to aid the accused if and when the accused requests help, and to be available to
represent the accused in the event that termination of . . . defendant’s self-representation is necessary.”
Faretta v California, 422 US 806, 834 n 46 (1975).
The motion for stay pending appeal is DENIED as moot.
This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
