REPORT AND RECOMMENDATION
The matter before the Court is the Joint Motion to Dismiss (ECF No. 131) filed by the
parties in this adversary proceeding. Pursuant to General Order No. 2011-12 in the United States

Order”), as well as Bankruptcy Local Rule 5011-1, this Court makes the following report and
recommendation to the District Court.
This adversary case has been pending since October 11, 2022. The reference was
withdrawn to the case to District Court on November 22, 2022. There, the District Court referred
all pretrial matters back to this Court. The parties settled the case and filed the instant joint motion.
This Court granted the joint Motion to dismiss. Because the District Court retained jurisdiction
over the final disposition of this case, it must also enter an order closing the case.
ACCORDINGLY, IT IS ORDERED that this adversary case is closed subject to
reopening for appropriate relief based on the Approved Compromise and Settlement (ECF No.
127) and Order of Dismissal (ECF No. 132).
