ORDER

Before the Court is United States Magistrate Judge Yvonne Y. Ho’s Memorandum and
Recommendation filed on November 21, 2025. Doc, #18, The deadline for filing objections has
passed, and no objections have been filed. Pursuant to Federal Rule of Civil Procedure 72(b), the
Court has reviewed the Memorandum and Recommendation for clear error. United States v.
Wilson, 864 F.2d 1219, 1221 (Sth Cir. 1989), Finding no clear error, the Court adopts the
Memorandum and Recommendation (Doc. #18) in its entirety.

As such, Plaintiff's Motion to Remand (Doc. #2) is GRANTED. Likewise, Plaintiffs
November 12, 2025 Motion (Doc. #16) is GRANTED IN PART, insofar as Plaintiff requests
remand, Accordingly, this case is hereby REMANDED to the 400th Judicial District Court of Fort
Bend County, Texas.

The November 12, 2025 Motion (Doc. #16) is DENIED IN PART, however, insofar as

Plaintiff requests fees and expenses under 28 U.S.C. § 1447(c). Finally, Defendant’s Motion to
