ORDER
On September 13, 2013, this Court entered an Order setting a briefing schedule in
connection with motions filed by Google, Inc. (Docket No. Misc. 13-03), Microsoft Corporation
(Docket No. Misc. 13-04), Yahoo! Inc. (Docket No. Misc. 13-05), and Facebook, Inc. (Docket
No. Misc. 13-06) for declaratory judgment regarding their ability to disclose aggregate
information about Foreign Intelligence Surveillance Act (FISA) orders received. On September
17, 2013, Linkln Corporation filed a Motion for Declaratory Judgment That Linkedin
Corporation May Report Aggregate Data Regarding FISA Orders (Docket No. Misc. 13-07).
Given the overlap in issues presented in these cases, the Court has decided to consolidate the
briefing schedules in all five dockets.
Accordingly, it is hereby ORDERED that the Government shall file a single response to
the motions in all five of the above-captioned dockets no later than 5:00 p.m. on September 30,
2013. Google, Inc., Microsoft Corporation, Yahoo! Inc., Facebook, Inc., and Linkin Corporation
may file a reply brief no later than 5:00 p.m. on October 21, 2013, through the Security and
Emergency Planning Staff, U.S. Department of Justice. Given the substantial similarity in the
relief sought and legal arguments presented in these cases, Google, Inc., Microsoft Corporation,
Yahoo! Inc., Facebook, Inc., and Linkin Corporation shall coordinate their efforts and jointly file
a single reply brief.
