DECISION & 	ORDER
CRAIB, 	Member: 	This 	case 	is before 	the Public Employment
Relations 	Board 	(Board) 	on 	appeal by Wholesale 	& 	Retail 	Food
Distribution Local 	63, 	International 	Brotherhood of 	Teamsters,
Chauffeurs, 	Warehousemen 	and Helpers 	of America 	(Teamsters)
from 	a 	Board 	agent's 	determination 	that 	the 	decertification
petition 	of 	the 	California 	School 	Employees 	Association 	(CSEA)
was 	timely filed. 	At 	issue 	is 	the 	appropriate 	termination date
for 	the most 	recent Teamsters' 	contract and, 	thus, 	whether 	that
contract 	is 	an 	effective bar 	to 	the decertification petition.

Subsequent 	to the 	filing of 	its 	appeal, 	the 	Teamsters
requested 	that 	the 	appeal be withdrawn. 	The 	Board has
considered 	the 	request and 	concurs 	that 	such 	a withdrawal 	is 	in
the best 	interests 	of 	the parties 	and 	is 	consistent with 	the
purposes 	of 	the 	Educational 	Employment 	Relations Act 	(Gov. 	Code
sec. 	3540 et seq.).
It 	is hereby ORDERED that 	the 	appeal 	of 	the 	Board agent's
determination 	in Case 	No. 	LA-D-234 	that 	CSEA's 	decertification
petition was 	timely 	filed 	is 	WITHDRAWN WITH PREJUDICE. 	The
Board's 	Chief 	of 	the 	Division of 	Representation 	is 	ORDERED 	to
take 	appropriate 	action 	consistent 	with 	this 	Decision.
