Résumé Omnilex

The Federal Administrative Court upheld the Beigeladene’s complaint against the denial of leave to appeal. It held that the case has fundamental importance because it may clarify whether the Telecommunications Act affords the Federal Network Agency a margin of appreciation when determining efficient-service costs and the hourly rates used for one-time charges, and how such determinations are to be reviewed by the courts. The decision also contains the cost and provisional value-of-claim determinations for the proceedings.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance justifying admission of the revision where clarification is needed as to whether sector-specific legislation affords the regulatory authority a margin of appreciation in determining efficient-service costs and the hourly rates underlying one-time charges, and according to which standards judicial review is to occur. The existence of a potentially revisable legal question suffices; it is not required that the answer be already settled in the admissibility stage. The complaint is therefore successful if the proffered question is capable of clarification in the revision proceedings (consid. 1).
