The Federal Administrative Court noted that the appellant withdrew its revision against the Baden-Württemberg Higher Administrative Court judgment with the respondent's consent. The revision proceedings were therefore terminated. The intervener's objection did not matter: under § 66 VwGO, an intervener may only submit substantive requests and cannot prevent termination of the dispute by withdrawal, because the intervener remains in a dependent procedural position.
§ 66 VwGO; effect of an intervener's objection to withdrawal of a revision: An intervener may make motions in the proceedings, but due to its dependent procedural status it cannot prevent termination of the case by withdrawal of the revision with the respondent's consent. This applies even where the intervener was joined as a necessary intervener; the intervener's lack of power to block termination follows from the ancillary nature of its participation (consid. 2).

Zur Stellung des Beigeladenen
1 Die Klägerin hat ihre Revision gegen das Urteil des Verwaltungsgerichtshofs Baden-Württemberg vom 24. Januar 2003 mit Schriftsatz vom 10. Mai 2013 mit Einwilligung der Revisionsbeklagten vom 22. Mai 2013 zurückgenommen. Das Revisionsverfahren ist deshalb gemäß § 141 Satz 1, § 125 Abs. 1 Satz 1, § 92 Abs. 3 Satz 1 VwGO einzustellen.
2 Der Beigeladene zu 1 hat der Zurücknahme der Revision widersprochen. Darauf kommt es prozessual indes nicht an. Ein Beigeladener kann nach § 66 VwGO lediglich Sachanträge stellen, aber nicht verhindern, dass der Streit ohne seine Zustimmung beendet wird. Dies folgt aus seiner abhängigen Stellung im Prozess, die selbst im Falle einer notwendigen Beiladung nicht entfällt (Urteil vom 15. November 1991 - BVerwG 4 C 27.90 - NVwZ-RR 1992, 276; Beschluss vom 7. Juni 1968 - BVerwG 4 B 165.67 - NJW 1968, 2395).
