Résumé Omnilex

The Federal Administrative Court upheld a complaint against non-admission of revision. It found that the case raises a question of fundamental importance: whether the res judicata effect of an administrative judgment granting protection in refugee law can be pierced by reliance on § 826 BGB, and if so under what conditions. Because that issue required clarification, the revision was admitted.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admissibility of revision for fundamental importance where clarification is needed on whether and under what conditions the res judicata effect of an administrative judgment in refugee-law proceedings may be overcome by invoking § 826 BGB. A question is of fundamental importance if it is unresolved and capable of clarification in the revision proceedings; the appeal is then to be allowed when the proposed review can contribute to development or uniform application of the law, even if the underlying dispute concerns the exceptional piercing of finality.
