Résumé Omnilex

The Federal Administrative Court upheld the plaintiff's complaint against the non-admission of revision. It held that the case presents a question of fundamental importance: whether a regulatory provision that indirectly refers to a privately authored technical standard protected by copyright and only obtainable for a fee complies with the requirements for proper promulgation of legal norms. The court therefore admitted the revision.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision admission for fundamental importance; indirect reference in a regulation to a privately authored technical standard protected by copyright and accessible only against payment may raise a revisable question of whether the requirements of proper promulgation of legal norms are satisfied. A legal question is of fundamental importance where its clarification in revision proceedings is capable of contributing to the uniform development of the law and is not yet settled; the court need only determine that such clarification appears possible and relevant (consid. 1).
