Hinzuziehung eines Bevollmächtigten im Vorverfahren

Gründe

1 Der Antrag, die Zuziehung eines Bevollmächtigten für das Vorverfahren für notwendig zu erklären (§ 162 Abs. 2 Satz 2 VwGO), ist begründet.

2 Nach der Rechtsprechung des Bundesverwaltungsgerichts zu § 162 Abs. 2 Satz 2 VwGO ist die Notwendigkeit der Hinzuziehung eines Bevollmächtigten im Vorverfahren unter Würdigung der jeweiligen Verhältnisse vom Standpunkt einer verständigen Partei aus zu beurteilen. Maßgebend ist, ob sich ein vernünftiger Bürger mit gleichem Bildungs- und Erfahrungsstand bei der gegebenen Sachlage eines Rechtsanwalts bedient hätte. Notwendig ist die Zuziehung eines Rechtsanwalts dann, wenn es der Partei nach ihren persönlichen Verhältnissen und wegen der Schwierigkeit der Sache nicht zuzumuten war, das Vorverfahren selbst zu führen. Die Notwendigkeit der Hinzuziehung wird auch durch die Bedeutung der Streitsache für den Beschwerdeführer bestimmt. Maßgeblich ist der Zeitpunkt der Bevollmächtigung (Beschluss vom 27. Februar 2012 - BVerwG 2 A 11.08 - m.w.N.).

3 Nach diesen Maßstäben war hier die Hinzuziehung eines Bevollmächtigten im Vorverfahren notwendig. Gegenstand des Verfahrens war die Frage, ob die als Tarifbeschäftigte bei der Beklagten tätige Klägerin ihre Verbeamtung beanspruchen konnte. In diesem Zusammenhang stellte sich eine Reihe von nicht ohne weiteres zu beantwortenden rechtlichen Fragen. Von der nicht juristisch vorgebildeten Klägerin konnte nicht erwartet werden, dieses Verfahren ohne Hinzuziehung eines Rechtsanwalts zu führen.
