The Federal Administrative Court admitted the defendant’s revision against a disciplinary judgment of the Higher Administrative Court of Berlin-Brandenburg. The court held that the case has fundamental importance because the revision can clarify under what conditions the equal opportunities officer must be involved in an administrative disciplinary proceeding under § 19(1) BGleiG.

Question juridique clé

Whether revision should be admitted for fundamental importance regarding the participation of the equal opportunities officer in disciplinary proceedings.

Solution extraite

Revision is admitted because the case raises a question of fundamental importance concerning the conditions under which the equal opportunities officer must be involved in an administrative disciplinary proceeding.

Motifs extraits

The legal question under § 19(1) BGleiG has not been clarified and can be decided in the revision proceedings; this justifies admission under § 132(2)(1) VwGO in conjunction with § 69 BDG.
