1 Die Beschwerde des Klägers ist zulässig und begründet.

2 Die Revision ist wegen grundsätzlicher Bedeutung der Rechtssache gemäß § 132 Abs. 2 Nr. 1 VwGO zuzulassen. Sie kann dem Bundesverwaltungsgericht Gelegenheit geben, die Voraussetzungen für den Nachzug eines ausländischen Ehegatten zu einem deutschen Staatsangehörigen gemäß § 28 Abs. 1 Satz 1 Nr. 1 AufenthG angesichts einer sogenannten "hinkenden" Ehe weiter zu klären.
