Gründe

1 Die Beschwerde ist hinsichtlich des zweiten Hilfsantrags - Zuerkennung der Befähigung zur Laufbahn des höheren Dienstes - zuzulassen. Es ist insoweit rechtsgrundsätzlich zu klären, ob der Vorstand der Deutschen Telekom AG einem Beamten die Anerkennung der Befähigung für die Laufbahn des höheren Dienstes versagen kann, obwohl er ihn nach erfolgreicher Absolvierung eines Studiengangs an einer Fachhochschule mit dem Hochschulgrad Diplom-Wirtschaftsjurist (FH) beurlaubt, um ihm im Angestelltenverhältnis eine Tätigkeit als Jurist zu übertragen, die einem Amt der Laufbahn des höheren Dienstes entspricht. Auf die Akkreditierung des Studiengangs und auf die fachliche Einordnung des Hochschulabschlusses durch die Hochschule kommt es nicht an.

2 Soweit die Beschwerde hinsichtlich des Hauptantrags und des ersten Hilfsantrags zurückgewiesen wird, hat der Kläger Zulassungsgründe im Sinne des § 132 Abs. 2 VwGO nicht dargelegt (§ 133 Abs. 3 Satz 3 VwGO). Die angestrebte Beförderung kommt ohne Anerkennung der Laufbahnbefähigung nicht in Betracht. Von einer weiteren Begründung wird insoweit gemäß § 133 Abs. 5 Satz 2 Alt. 2 VwGO abgesehen.
