Résumé Omnilex

The Federal Administrative Court upheld the complaint against non-admission of revision. It held that the case has fundamental significance because the revision proceedings can clarify what requirements apply to a public-law contract that changes a delegation of sovereign powers so that a different person becomes the delegate. The court also determined the value in dispute for the revision proceedings under the Court Costs Act.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; revision admissibility for fundamental significance in a case concerning the amendment of a delegation by public-law contract: Fundamental significance exists where the revision proceedings are likely to clarify unresolved requirements for a public-law contract by which a delegation of sovereign powers is altered so that a different person replaces the previous delegate. For the admission of revision, it suffices that a clarifying answer to the legal question is expected in the revision proceedings (consid. 1).
