The Federal Administrative Court refused the plaintiff’s application for legal aid in connection with a complaint against the denial of leave to appeal a judgment of the Administrative Court of Appeal of Rhineland-Palatinate. The court held that the intended challenge had no sufficient prospects of success because the complaint had not been adequately substantiated within the time limit. It further stated that reinstatement into the substantiation period under Section 60 VwGO is unavailable where an attorney-represented complainant did not, before expiry of the deadline, at least outline in broad terms the asserted ground for leave to appeal under Section 132(2) VwGO. A mere reference to prior submissions and a general assertion of efforts to obtain identity documents was insufficient.

Reinstatement into the complaint-substantiation period is excluded if the lawyer, before expiry of the deadline, failed to present at least the outlines of a ground for leave to appeal. A timely legal-aid application does not suspend the substantiation requirement; what is required is a minimum of argumentation enabling the court to assess whether a ground for leave exists (consid. 2). Mere incorporation by reference to prior briefs is insufficient.

1 Der Kläger hat Beschwerde gegen die Nichtzulassung der Revision im Urteil des Oberverwaltungsgerichts Rheinland-Pfalz vom 19. Februar 2010 eingelegt. Seinem Antrag auf Bewilligung von Prozesskostenhilfe und Beiordnung seiner Prozessbevollmächtigten für das Verfahren der Nichtzulassungsbeschwerde und des sich ggf. anschließenden Revisionsverfahrens kann nicht stattgegeben werden, denn die beabsichtigte Rechtsverfolgung bietet keine hinreichende Aussicht auf Erfolg (§ 166 VwGO i.V.m. § 114 Satz 1, § 121 Abs. 1 ZPO).

2 Die Beschwerde des Klägers gegen die Nichtzulassung der Revision wird schon deshalb keinen Erfolg haben können, weil sie nicht innerhalb der Frist des § 133 Abs. 3 Satz 1 VwGO ausreichend begründet worden ist. Eine Wiedereinsetzung gem. § 60 VwGO in diese Frist wegen eines rechtzeitig gestellten Antrags auf Bewilligung von Prozesskostenhilfe kommt dann nicht in Betracht, wenn der - anwaltlich vertretene - Beschwerdeführer nicht bis zum Ablauf der Beschwerdebegründungsfrist wenigstens in groben Zügen dargelegt hat, inwiefern er einen Zulassungsgrund i.S.d. § 132 Abs. 2 VwGO für gegeben hält (stRspr, vgl. Beschlüsse vom 17. September 1964 - BVerwG 8 B 57.64 - Buchholz 310 § 60 VwGO Nr. 34, vom 13. September 1989 - BVerwG 1 ER 619.89 - Buchholz 310 § 166 VwGO Nr. 20 und vom 1. September 1994 - BVerwG 11 PKH 4.94 - Buchholz 436.36 § 17 BAföG Nr. 16). Dazu gehört ein gewisses Maß an Begründung, das dem Gericht eine ausreichende Grundlage für die Prüfung der Frage bietet, ob die Revision zuzulassen ist und die beabsichtigte Rechtsverfolgung deshalb hinreichende Aussicht auf Erfolg bietet.

3 Diesen Anforderungen genügt die Begründung der Prozessbevollmächtigten des Klägers im Schriftsatz vom 14. April 2010 nicht. Der Verweis auf die bisherigen Schriftsätze sowohl im erst- als auch im zweitinstanzlichen Verfahren verbunden mit der Behauptung, der Kläger habe alles ihm Mögliche getan, um Ausweispapiere zu erhalten, reicht dafür nicht aus.
