Résumé Omnilex

The Federal Administrative Court allowed the complaint against the refusal to admit revision. It held that the case has fundamental importance because the revision will likely clarify when a patient transport service operated by a rehabilitation provider between patients’ homes and the facility requires a permit under the Passenger Transport Act. The court also provisionally set the value in dispute for the revision proceedings.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance: A complaint is successful where the case presents an unresolved, general legal question whose clarification is expected in the revision proceedings. Fundamental importance exists in particular when the contested legal classification of a recurring operational model depends on the interpretation of statutory permit requirements; it is sufficient that the revision is likely to provide clarification of the relevant conditions (consid. 1).
