The Federal Administrative Court allowed revision in a disciplinary matter concerning the possible binding effect of a final Slovak criminal judgment under § 57 BDG. 1 Die Revision wird wegen grundsätzlicher Bedeutung der Rechtssache zugelassen (§ 132 Abs. 2 Nr. 1 VwGO). Das Revisionsverfahren erscheint geeignet, zur Klärung der von der Beschwerde aufgeworfenen Frage beizutragen, ob und, wenn ja, welche Bindungswirkung einem rechtskräftigen Urteil eines ausländischen Strafgerichts nach § 57 BDG im Disziplinarverfahren zukommt. Bei dem in Streit über die disziplinare Bindungswirkung stehendem Urteil handelt es sich um das Strafurteil eines slowakischen Gerichts, das in der Bundesrepublik Deutschland nach Art. 54 des Übereinkommens zur Durchführung des Schengener Abkommens (Schengener Durchführungsübereinkommen - SDÜ - ABI. EG 2000 L 239/219) in Verbindung mit Art. 50 der durch den Vertrag von Lissabon am 1. Dezember 2009 in Kraft getretenen Charta der Grundrechte der Europäischen Union (EUGRCh, BGBI. II S. 1233) zu einem Strafklageverbrauch führt.
