Résumé Omnilex

The Federal Administrative Court admitted the appeal on points of law. It held that the case presents a question of fundamental importance: what requirements a member state must meet for an opt-out arrangement allowing voluntary overtime in fire service shift work to exceed 48 hours per week under Art. 22(1) of Directive 2003/88/EC.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance: A case is of fundamental importance where the appellate proceedings can contribute to clarifying the requirements of a member-state opt-out rule permitting voluntary additional shift work in the fire service beyond a weekly working time of 48 hours under Art. 22(1) of Directive 2003/88/EC. It is sufficient that the contested legal question is capable of general clarification in the revision proceedings.
