Résumé Omnilex

The Federal Administrative Court granted leave to appeal in a dispute over firefighter working time. It held that the complaint raised a question of fundamental significance: what requirements an opt-out rule under Article 22(1) of Directive 2003/88/EC must satisfy for voluntary overtime in fire service work beyond 48 weekly hours. The court therefore allowed the revision under § 132(2) No. 1 VwGO.

Regeste Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admissibility of revision for fundamental significance in relation to Art. 22(1) of Directive 2003/88/EC: Revision is to be admitted where the complaint raises a legally significant and clarifiable question of general importance concerning the requirements of a Member State opt-out arrangement for voluntary additional shift work in fire service employment beyond a 48-hour weekly working time. It suffices that the intended revision proceedings are capable of contributing to the clarification of the legal standard (consid. 1).
