Résumé Omnilex

The Federal Administrative Court admitted the claimant’s revision. It held that the case raises a question of fundamental importance: whether the partial offset of permanent performance allowances, based on a promotion agreement, by the increased base salary resulting from the 2013 W-salary reform in Rhineland-Palatinate is constitutional under § 69 Abs. 7 BesG RP. The court also noted that the provisional value of the subject matter for the revision proceedings follows the appellate court’s valuation.

Regeste Omnilex

Question juridique clé

Whether revision should be allowed for the question whether § 69 Abs. 7 BesG RP is constitutional insofar as it partially offsets permanent performance allowances against increased base salary.

Solution extraite

Revision was admitted because the case raises a question of fundamental importance and the appellate review is suitable to clarify the constitutionality of the offset rule.

Motifs extraits

The court found that the proposed cassation issue concerns a legally unresolved, general question under § 132 Abs. 2 Nr. 1 VwGO, namely whether the salary increase may constitutionally consume permanent performance allowances based on a promotion agreement.
