1 Die Beschwerde des Klägers ist zulässig und begründet. Die Revision ist nach § 132 Abs. 2 Nr. 1 VwGO wegen grundsätzlicher Bedeutung der Rechtssache zuzulassen.

2 Die Revision kann dem Senat Gelegenheit zur Klärung der Frage geben, ob die Bestimmung des § 17 Abs. 7 Satz 1 der Niedersächsischen Beihilfeverordnung (NBhVO) vom 7. November 2011 (Nds. GVBl. S. 372) mit höherrangigem Recht in Einklang steht.
