The Federal Fiscal Court rejected the plaintiff's complaint against denial of leave to appeal against the Munich Fiscal Court judgment. Leitsatz

NV: Allein der Hinweis, dass zu einem bestimmten Gesichtspunkt nichts in den Entscheidungsgründen steht, genügt für eine schlüssige Rüge der Verletzung der Pflicht des FG, nach seiner aus dem Gesamtergebnis des Verfahrens gewonnenen Überzeugung zu entscheiden, nicht.

Tenor

Die Beschwerde des Klägers wegen Nichtzulassung der Revision gegen das Urteil des Finanzgerichts München, Außensenate Augsburg, vom 9. Juli 2015 15 K 3325/14 wird als unbegründet zurückgewiesen.

Die Kosten des Beschwerdeverfahrens hat der Kläger zu tragen.

Gründe

1 Die Beschwerde hat keinen Erfolg.

2 In der Sache wendet sich der Kläger und Beschwerdeführer (Kläger) maßgeblich gegen die materiell-rechtliche Richtigkeit der finanzgerichtlichen Entscheidung. Damit ist weder der Revisionszulassungsgrund der Divergenz (§ 115 Abs. 2 Nr. 2 2. Alternative der Finanzgerichtsordnung --FGO--) dargetan noch in schlüssiger Weise ein Verfahrensfehler i.S. von § 115 Abs. 2 Nr. 3 FGO. Dies gilt insbesondere, soweit die Beschwerde eine unrichtige Anwendung der höchstrichterlichen Rechtsprechung geltend macht sowie eine fehlerhafte Tatsachen- bzw. Beweiswürdigung seitens des Finanzgerichts (FG). Dem FG ist auch nicht Willkür vorzuwerfen.

3 Weiter hat der Kläger nicht schlüssig dargelegt, dass das FG seine Pflicht zur Sachaufklärung gemäß § 76 Abs. 1 FGO oder zur Entscheidung auf der Grundlage des Gesamtergebnisses des Verfahrens gemäß § 96 Abs. 1 FGO verletzt hätte. Was die Verletzung der Sachaufklärungspflicht betrifft, hat der Kläger sein Rügerecht verloren, indem er in der mündlichen Verhandlung keine weitere Sachaufklärung beantragt hat. Für eine schlüssige Darlegung der Verletzung von § 96 Abs. 1 FGO genügt allein der Hinweis, dass zu einem bestimmten Gesichtspunkt nichts in den Entscheidungsgründen steht, nicht. Es ist grundsätzlich davon auszugehen, dass ein Gericht die ihm vorliegenden Akten und die Äußerungen der Beteiligten bzw. das Ergebnis einer Beweisaufnahme bei seiner Entscheidungsfindung berücksichtigt und die sich daraus ergebenden Tatsachen und Rechtsfragen gewürdigt hat, sofern nicht konkrete Anhaltspunkte hiergegen sprechen. Solche Anhaltspunkte fehlen vorliegend.

4 Die Kostenentscheidung beruht auf § 135 Abs. 2 FGO.
