Leitsatz

  1. NV: § 35b GewStG ermöglicht eine Aussetzung der Vollziehung des Gewerbesteuermessbescheids auch dann, wenn nur der weitere in dieser Vorschrift erwähnte Bescheid (Einkommensteuer-, Körperschaftsteuer- oder Gewinnfeststellungsbescheid), nicht aber der Gewerbesteuermessbescheid selbst angefochten wurde.

  2. NV: Daraus folgt, dass der BFH in Bezug auf die Aussetzung der Vollziehung eines Gewerbesteuermessbescheids auch dann "Gericht der Hauptsache" i.S. des § 69 Abs. 3 Satz 1 FGO ist, wenn bei ihm lediglich ein Hauptsacheverfahren wegen des weiteren in § 35b GewStG genannten Bescheids, nicht aber wegen des Gewerbesteuermessbescheids anhängig ist.

Gründe

1 1. Der Bundesfinanzhof (BFH) ist als "Gericht der Hauptsache" i.S. des § 69 Abs. 3 Satz 1 der Finanzgerichtsordnung (FGO) auch insoweit für die Entscheidung zuständig, als sie die Gewerbesteuermessbescheide betrifft.

2 Zwar ist insoweit weder ein gerichtliches Hauptsacheverfahren anhängig noch ist der Einkommensteuerbescheid Grundlagenbescheid für den Gewerbesteuermessbescheid. Aus der Regelung des § 35b des Gewerbesteuergesetzes (GewStG), die nach ständiger Gerichts- und Verwaltungspraxis eine Aussetzung der Vollziehung des Gewerbesteuermessbescheids auch dann ermöglicht, wenn nur der weitere in dieser Vorschrift genannte Bescheid (Einkommensteuer-, Körperschaftsteuer- oder Gewinnfeststellungsbescheid), nicht aber der Gewerbesteuermessbescheid selbst angefochten wurde (BFH-Beschluss vom 27. Januar 1977 IV B 72/74, BFHE 121, 289, BStBl II 1977, 367; R 1.7 Abs. 2 der Gewerbesteuer-Richtlinien 2009), folgt aber zugleich die instanzielle Zuständigkeit desjenigen Gerichts, bei dem ein Hauptsacheverfahren wegen des weiteren in § 35b GewStG genannten Bescheids anhängig ist (vgl. BFH-Beschluss vom 11. Mai 2000 I S 1/00, BFH/NV 2000, 1350).

3 Die vom III. Senat des BFH für derartige Fälle ergänzend geforderte Voraussetzung, dass auch ein Aussetzungsverfahren wegen des weiteren in § 35b GewStG genannten Bescheids beim BFH anhängig sein müsse (so BFH-Beschluss vom 6. Dezember 2002 III S 5/02, BFH/NV 2003, 492, unter II.2.b), ist im Streitfall erfüllt.

4 2. Der Antrag ist mangels Beschwer unzulässig, soweit er die Einkommensteuer 1992 betrifft. Mit dem vom Antragsteller bezeichneten geänderten Bescheid vom 30. Juli 2013 ist die Einkommensteuer 1992 auf 0 DM herabgesetzt worden. Aus diesem Bescheid droht dem Antragsteller keine Vollziehung.

5 3. Im Übrigen sind die Anträge begründet. Es bestehen ernstliche Zweifel an der Rechtmäßigkeit der angefochtenen Bescheide. Der Senat verweist insoweit auf seinen Beschluss vom 5. Februar 2014 im Verfahren X B 138/13.

6 4. Die im Verfahren X S 49/13 nach dem Verhältnis des Obsiegens und Unterliegens getroffene Kostenentscheidung beruht auf § 136 Abs. 1 Satz 1 FGO; die Kostenentscheidung im Verfahren X S 56/13 beruht auf § 135 Abs. 1 FGO.
