The revision dispute over the tax treatment of a business transfer became moot after both parties declared the matter resolved in the main proceedings. The Federal Fiscal Court held that the challenged first-instance judgment, including its cost ruling, had become irrelevant and that only the costs of the entire proceedings remained to be decided. Applying § 138(2) sentence 1 FGO, the court ordered the respondent tax office to bear the costs because it had amended the challenged assessment as requested.
§ 138 Abs. 2 Satz 1 FGO; costs after mootness in revision proceedings: If the main proceedings become moot by mutual declarations in the revision instance, the challenged judgment, including its cost ruling, loses effect and the court decides only on the costs of the entire proceedings. Costs are allocated according to the outcome of the requested administrative change; if the respondent authority grants the requested relief by amending the contested act, it bears the costs. The previous merits dispute is not examined further (consid. 1 f.).

NV: Nach Erledigung der Hauptsache (nach Abhilfe durch das Finanzamt im Hinblick auf die Entscheidungen des BVerfG vom 07. Juli 2010 2 BvR 748/05, 2 BvR 753/05, 2 BvR 1738/05, BFH/NV 2010, 1976, zu § 17 EStG, und 2 BvL 14/02, 2 BvL 2/04, 2 BvL 13/05, BFH/NV 2010, 1959, zu § 23 EStG) ist nur noch über die Kosten zu entscheiden.
1 1. Der Rechtsstreit ist infolge der übereinstimmenden Erklärungen der Beteiligten in der Hauptsache erledigt. Da diese Erklärungen erst im Revisionsverfahren abgegeben wurden, ist das angefochtene Urteil einschließlich der darin enthaltenen Kostenentscheidung gegenstandslos geworden. Der Senat hat nunmehr noch über die Kosten des gesamten Verfahrens zu entscheiden (Beschluss des Bundesfinanzhofs vom 5. April 2004 XI R 29/00, BFH/NV 2004, 1282).
2 2. Die Kostenentscheidung beruht auf § 138 Abs. 2 Satz 1 der Finanzgerichtsordnung. Der Beklagte und Revisionsbeklagte (das Finanzamt) hat den angefochtenen Bescheid antragsgemäß geändert.
