Leitsatz

NV: Das dem Gericht bei der Bestimmung von Art und Zahl einzuholender Sachverständigengutachten zustehende Ermessen wird nur dann verfahrensfehlerhaft ausgeübt, wenn es von der Einholung gutachtlicher Stellungnahmen absieht, obwohl sich ihm die Notwendigkeit einer zusätzlichen Beweiserhebung hätte aufdrängen müssen .

Gründe

1 Gründe für die Zulassung der Revision (§ 115 Abs. 2 der Finanzgerichtsordnung --FGO--) liegen nicht vor.

2 1. Soweit das Finanzgericht im Streitfall davon abgesehen hat, ein weiteres Sachverständigengutachten einzuholen, liegt darin kein Verfahrensmangel. Nach § 82 FGO i.V.m. §§ 404, 412 der Zivilprozessordnung (ZPO) kann das Gericht eine neue Begutachtung anordnen, wenn es das Gutachten für ungenügend erachtet. Im Streitfall hat sich das Gericht jedoch den Ausführungen des gerichtlichen Gutachters angeschlossen und die dagegen von den Klägern und Beschwerdeführern (Kläger) geltend gemachten Einwände nicht durchgreifen lassen (vgl. § 96 Abs. 1 Satz 1 FGO). Das dem Gericht bei der Bestimmung von Art und Zahl einzuholender Sachverständigengutachten zustehende Ermessen wird nur dann verfahrensfehlerhaft ausgeübt, wenn es von der Einholung gutachtlicher Stellungnahmen absieht, obwohl sich ihm die Notwendigkeit einer zusätzlichen Beweiserhebung hätte aufdrängen müssen. Dies ist hier nicht der Fall.

Die Beschwerde kann auch deswegen keinen Erfolg haben, weil die Kläger die mangelnde Beweiserhebung in der mündlichen Verhandlung nicht gerügt, sondern im Gegenteil ausdrücklich zu Protokoll erklärt haben, dass über die Vernehmung des Zeugen E. hinaus keine weiteren Beweisanträge gestellt werden. Damit hätten sie jedenfalls auch das Rügerecht verloren (§ 155 FGO i.V.m. § 295 Abs. 1 ZPO).
