The Federal Constitutional Court, 1st Senate, 3rd Chamber, held that the recusal motion directed against Vice President Kirchhof and other chamber judges was abusive and therefore inadmissible. It decided in its original composition and, under Section 93d(1) sentence 3 BVerfGG, dispensed with further reasons. The constitutional complaint itself was not accepted for decision. The decision is final.
§ 19 Abs. 1, Abs. 2 Satz 1 BVerfGG; § 93d Abs. 1 Satz 3 BVerfGG: An obviously abusive motion to recuse a constitutional judge is inadmissible and may be dismissed in the original chamber composition, including the judge challenged by the motion, without prior substitution. In proceedings on the non-acceptance of a constitutional complaint, the Chamber may refrain from providing further reasons if the requirements of Section 93d(1) sentence 3 BVerfGG are met.

1 Die Kammer entscheidet unter Mitwirkung des Vizepräsidenten Kirchhof und ihrer weiteren Mitglieder. Das gegen sie angebrachte Ablehnungsgesuch ist rechtsmissbräuchlich.
2 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
3 Diese Entscheidung ist unanfechtbar.
