The Federal Constitutional Court did not admit the constitutional complaint against the Local Court of Sinzig. The Court found that the lower court had not sufficiently addressed the constitutional classification of question-form statements and had failed to balance freedom of expression against personal honor. Where a lower court omits the required balancing under Art. 5(1) sentence 1 GG and the affected person's personal honor, this may raise constitutional concerns; however, admission of the constitutional complaint is nevertheless to be refused if no especially serious disadvantage exists and it is clearly foreseeable that remittal could not lead to a different substantive outcome, in particular because the statements lack factual basis and the impairment of honor may prevail (consid. 1-2).

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Gründe

1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, da kein besonders schwerer Nachteil im Sinne von § 93a Abs. 2 Buchstabe b BVerfGG vorliegt. Es ist deutlich abzusehen, dass der Beschwerdeführer auch im Falle der Zurückverweisung an das Ausgangsgericht im Ergebnis keinen Erfolg haben würde (vgl. BVerfGE 90, 22 <25 f.>).

2 Die Einordnung der Äußerungen des Beschwerdeführers als Tatsachenbehauptungen ohne weitere Begründung wird zwar den verfassungsrechtlichen Anforderungen an die Auslegung einer Äußerung nicht gerecht. Das Amtsgericht, das mit vertretbarer Begründung das Vorliegen echter Fragen verneint, verkennt, dass auch Fragesätze als Werturteile einzuordnen sein können, und unterlässt die verfassungsrechtlich gebotene Abwägung der Meinungsfreiheit des Beschwerdeführers aus Art. 5 Abs. 1 Satz 1 GG und der persönlichen Ehre des von den Äußerungen Betroffenen (vgl. BVerfGE 99, 185 <196 f.>; 114, 339 <348>; EGMR, von Hannover v. Deutschland, Urteil vom 7. Februar 2012, Nr. 40660/08 u. 60641/08, §§ 108-113). Da es für die mit den Fragesätzen geäußerten Vermutungen des Beschwerdeführers aber keine tatsächliche Anhaltspunkte gibt und diese die persönliche Ehre des Betroffenen nicht unerheblich beeinträchtigen, kann die Abwägung im Ergebnis zu einem Überwiegen der Belange der persönlichen Ehre führen, so dass es - zumal es nur noch um die Rechtsanwaltskosten geht - an einem Grund zur Annahme der Verfassungsbeschwerde fehlt.

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
