Résumé

The Federal Constitutional Court did not accept the constitutional complaint filed by a biological father seeking contact with his child living in the household of the legal parents. The Court held that the complaint was inadmissible because it did not meet the substantiation requirements of §§ 23(1) sentence 2 and 92 BVerfGG. In particular, the complainant failed to address the Higher Regional Court's independent reason that contact would not serve the child's best interests due to the risk of loyalty conflicts in a highly strained family situation. The complaint also did not sufficiently show any constitutionally required procedural deficiency.

Regest

§§ 23 Abs. 1 S. 2, 92 BVerfGG; substantiation requirements for a constitutional complaint: a complaint is inadmissible if it does not engage with each independently supporting ground of the challenged decision and does not sufficiently identify a constitutional violation. Where the Fachgericht denies contact between a biological father and a child on the basis that, in light of a severely strained relationship and the danger of loyalty conflicts, contact is not conducive to the child's welfare, the constitutional complaint must specifically confront this autonomous reasoning (consid. 2). Mere general criticism or incomplete review of procedural objections does not satisfy the pleading burden. The Court may refrain from further reasoning under § 93d Abs. 1 sentence 3 BVerfGG.
