The Federal Constitutional Court rejected a recusal motion directed against the members of the Second Senate as inadmissible and dismissed the election review complaint. The Court stated that the complaint had no prospect of success for the reasons set out in the rapporteur's letter of 3 February 2016 and therefore dispensed with any further reasoning under § 24 sentence 2 BVerfGG.
§ 24 Satz 2 BVerfGG; election review complaint; summary dismissal without further reasoning; recusal motion. A motion to recuse members of the Federal Constitutional Court is inadmissible where it does not meet the statutory requirements. If an election review complaint is manifestly unfounded or otherwise lacks merit for the reasons previously communicated by the rapporteur, the Court may dismiss it by order and, pursuant to § 24 sentence 2 BVerfGG, refrain from giving additional reasons.
