The Federal Constitutional Court did not admit the constitutional complaint concerning prison dental care. Gründe

1 Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen, da sie keine Aussicht auf Erfolg hat. Die Entscheidung des Landgerichts, den Antrag des Beschwerdeführers auf Erlass einer einstweiligen Anordnung abzulehnen, bewegt sich im Rahmen des fachgerichtlichen Wertungsspielraums.

2 Zwar sind auch medizinische Einschätzungen des Anstaltsarztes nicht jeder gerichtlichen Kontrolle entzogen (vgl. BVerfG, Beschluss der 3. Kammer des Zweiten Senats vom 15. November 2012 - 2 BvR 683/11 -, juris, Rn. 3; BVerfG, Beschluss der 3. Kammer des Zweiten Senats vom 5. Mai 2014 - 2 BvR 1823/13 -, juris, Rn. 22). Es ist jedoch nicht ersichtlich, dass dem Landgericht hinreichende Anhaltspunkte dafür vorlagen, dass eine ausreichende zahnmedizinische Versorgung des Beschwerdeführers in der Justizvollzugsanstalt nicht gesichert sein könnte.

3 Zweifel an einer genügenden zahnmedizinischen Versorgung des Beschwerdeführers und Anlass für eine weitere Sachaufklärung könnten sich zwar aus dem Schreiben der Justizvollzugsanstalt vom 21. Januar 2016, das eine ergänzende Stellungnahme des Anstaltsarztes enthält, ergeben. Dieses Schreiben lag dem Landgericht bei Erlass des angegriffenen Beschlusses jedoch noch nicht vor und kann daher nur bei einer etwaigen weiteren Entscheidung des Landgerichts berücksichtigt werden (vgl. § 114 Abs. 2 Satz 3 Halbsatz 2 StVollzG).

4 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

5 Diese Entscheidung ist unanfechtbar.
