The Federal Constitutional Court did not admit the constitutional complaint. The complainant could not rely on Art. 13 GG to challenge the search of his tax adviser’s premises because he was not personally affected in that respect. As to the alleged violation of the right to be heard, he had not filed a hearing complaint, so the legal remedy was not exhausted under § 90(2) sentence 1 BVerfGG. The Court therefore left open whether the criminal suspicion in the search order and the seizure of numerous computers were sufficiently precise and proportionate. The request for interim relief thus lapsed.

Art. 13 GG; Art. 103 Abs. 1 GG; § 90 Abs. 2 S. 1 BVerfGG: A constitutional complaint is inadmissible if the complainant is not personally and directly affected by the challenged search measure, in particular where the search concerns premises of a third party such as a tax adviser. A complaint alleging a violation of the right to be heard is likewise inadmissible unless the available remedy of a hearing complaint has first been pursued. If inadmissibility follows from lack of standing or failure to exhaust legal remedies, the Court need not decide on the sufficiency of the suspect description or the proportionality of seizure and search measures (consid. 1 ff.).

Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen, weil sie unzulässig ist. Der Beschwerdeführer ist für die geltend gemachte Verletzung von Art. 13 GG nicht beschwerdebefugt, soweit die Durchsuchung von Räumlichkeiten seines Steuerberaters angegriffen wird; im Übrigen hat er im Hinblick auf die mit der Verfassungsbeschwerde der Sache nach unter anderem gerügte Verletzung des Art. 103 Abs. 1 GG die Erhebung einer Anhörungsrüge versäumt und damit den Rechtsweg nicht erschöpft. Offen bleiben kann daher, ob der gegen den Beschwerdeführer bestehende Tatvorwurf im Durchsuchungsbeschluss des Amtsgerichts vom 9. Juli 2015 - 1 Gs 735/15 - hinreichend bestimmt bezeichnet ist, und ob die Beschlagnahme einer Vielzahl von Computern durch den Beschluss des Amtsgerichts vom 15. Oktober 2015 - 1 Gs 1121/15 - noch verhältnismäßig ist, obwohl zuvor eine Beschränkung der als Beweisgegenstände in Betracht kommenden Daten beziehungsweise Computer mit Hilfe einer Durchsicht der vorläufig sichergestellten Datenträger nach § 110 StPO möglich gewesen wäre.

Damit erledigt sich der Antrag auf Erlass einer einstweiligen Anordnung.

Diese Entscheidung ist unanfechtbar.
