Résumé Omnilex

The Federal Constitutional Court did not admit the complainant's constitutional complaint. She had met the requirements for the pension for especially long insured persons, but could not switch to it because she was already receiving a reduced old-age pension for women. The Court held that her submissions, directed largely against the design of § 236b SGB VI, were ineffective in light of the statutory switch prohibition in § 34(4) No. 3 SGB VI. The Court also dispensed with further reasoning under § 93d(1) sentence 3 BVerfGG.

Regeste Omnilex

Art. 34 Abs. 4 Nr. 3 SGB VI; § 236b SGB VI; constitutional complaint against exclusion of a pension switch: a person who already draws an old-age pension with deductions cannot later switch to the deduction-free pension for especially long-insured persons, even if the substantive requirements of § 236b SGB VI are met. In such a constellation, submissions directed against the structure of § 236b SGB VI are irrelevant, because the decisive obstacle lies in the statutory prohibition on changing old-age pensions. The Federal Constitutional Court may refrain from giving further reasons under § 93d Abs. 1 sentence 3 BVerfGG.

Normen: GG, § 34 Abs 4 Nr 3 SGB 6, § 236b SGB 6

Vorinstanz: vorgehend Landessozialgericht Baden-Württemberg, 21. Mai 2015, Az: L 7 R 5354/14, Urteilvorgehend SG Mannheim, 20. November 2014, Az: S 6 R 2856/14, Urteil

Titelzeile

Question juridique clé

Whether the constitutional complaint against the pension design for especially long-insured persons was admissible and well-founded.

Solution extraite

The complaint was not admitted; the complainant's arguments missed the point because the statutory ban on switching old-age pensions prevented her from moving to the deduction-free pension.

Motifs extraits

She satisfied the material requirements for the desired pension, but § 34(4) No. 3 SGB VI barred the switch since she was already drawing another old-age pension. The Court therefore saw no constitutional issue requiring further reasoning.
