Résumé Omnilex

The Federal Constitutional Court did not accept a constitutional complaint against a Social Court order denying legal aid. It held that the complaint failed to satisfy the subsidiarity requirement because the applicant had not first used the hearing objection under § 178a SGG. Since the alleged violation could have been addressed in the specialized proceedings, the constitutional complaint was inadmissible.

Regeste Omnilex

Art. 103(1) GG; § 90(2) BVerfGG; § 178a SGG; subsidiarity of the constitutional complaint: where a hearing objection is available to avert or remedy an alleged violation in the specialized proceedings, the complainant must use that remedy before lodging a constitutional complaint. This applies in particular if the alleged breach consists in the failure to give a procedural indication or hearing notice; the objection is a suitable and, as a rule, necessary preliminary remedy (consid. 1).

Titelzeile

Question juridique clé

Whether the constitutional complaint was admissible despite no prior hearing objection under § 178a SGG.

Solution extraite

No. The complaint was not accepted because the subsidiarity principle was not observed; the applicant should first have raised a hearing objection before the Social Court.

Motifs extraits

A hearing objection can prevent or remedy an alleged violation already in the specialist proceedings. Since the Social Court had denied legal aid because submitted documents did not cover the required period, and the applicant claimed to have complied fully, it was appropriate to first challenge the missing indication by hearing objection.
