The Federal Constitutional Court refused to admit a constitutional complaint arising from paternity-challenge proceedings. After the complainant's son died before the proceedings ended, she sought to continue the action and participate in it. The Court held that the constitutional protection of family ties does not give a parent a right to continue a deceased child's paternity challenge in order to sever the legal relationship to the grandchild. The challenged decisions of the Federal Court of Justice were therefore not constitutionally objectionable.

Gründe

1 Die Verfassungsbeschwerde betrifft ein Vaterschaftsanfechtungsverfahren, welches der vor Abschluss des Anfechtungsverfahrens verstorbene Sohn der Beschwerdeführerin gegenüber seinem Kind (dem Enkelkind der Beschwerdeführerin) eingeleitet hatte. Die Beschwerdeführerin wendet sich dagegen, dass ihr nach dem Tod ihres Sohnes die Beteiligung an dem von ihm eingeleiteten Vaterschaftsanfechtungsverfahren verwehrt wurde und dass es die Gerichte abgelehnt haben, dieses Vaterschaftsanfechtungsverfahren auf ihren Antrag hin fortzusetzen. Den Kern ihrer materiell- und verfahrensrechtlichen Rügen bildet der Vorwurf, indem ihr die Fortführung des Vaterschaftsanfechtungsverfahrens verwehrt werde, werde unzulässig in ihre Grundrechte eingegriffen, weil ihr auf diese Weise ein Enkelkind "aufgedrängt" werde.

2 Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen, weil die Voraussetzungen des § 93a BVerfGG nicht vorliegen. Die Entscheidungen des Bundesgerichtshofs sind verfassungsrechtlich nicht zu beanstanden. Der Bundesgerichtshof hat bei der Auslegung des anzuwendenden Rechts keine grundrechtlich geschützten Positionen der Beschwerdeführerin verkannt. Insbesondere folgt aus dem grundrechtlichen Schutz familiärer Bindungen zwischen nahen Verwandten (Art. 6 Abs. 1 GG; vgl. dazu BVerfGE 136, 382 <389, Rn. 23>) nicht umgekehrt, dass der Beschwerdeführerin hier von Verfassungs wegen die Möglichkeit eingeräumt werden müsste, durch Fortführung des von ihrem Sohn eingeleiteten Vaterschaftsanfechtungsverfahrens die rechtliche Verbindung zu ihrem - nach Einschätzung des verstorbenen Sohnes mutmaßlich nicht biologisch von diesem abstammenden - Enkelkind zu lösen.

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
