The First Chamber of the Second Senate of the Federal Constitutional Court refused to admit the constitutional complaint. The complainants had been successful before the Federal Labour Court, and the Court held that they were therefore not personally burdened by the challenged judgment. For that reason, the complaint lacked admissibility under Section 90(1) BVerfGG and was dismissed without reasoning. The decision is final.

§ 90 Abs. 1 BVerfGG; constitutional complaint by a party prevailing in the underlying proceedings; lack of present grievance. A constitutional complaint is admissible only if the complainant is personally, presently and directly affected by the challenged act. A merely favorable substantive decision of the specialised court does not create a constitutional grievance, even if the complainant contests the legal reasoning or ancillary considerations. A prevailing party is thus not entitled to seek constitutional review of the judgment itself for want of burden (consid. 1).

Bundesverfassungsgericht, Beschluss vom 15. Juli 2015 - 2 BvR 2292/13 -, juris, Rn. 46 ff.).

Diese Entscheidung ist unanfechtbar.
