The Federal Constitutional Court refused to accept a constitutional complaint lodged by the speaker of a prisoner association concerning alleged obstruction of union activity in a prison. It held that the complaint was manifestly inadmissible because it was insufficiently substantiated: the applicant did not describe the concrete prison measures, the specific activities allegedly hindered, or the exhaustion of legal remedies and timeliness requirements. As a result, the simultaneously requested interim relief became moot.

Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen und damit erledigt sich zugleich der Antrag auf Erlass einer einstweiligen Anordnung.

Gründe

I.

1 Die Verfassungsbeschwerde des Sprechers einer Verbindung von Strafgefangenen, die die Behinderung seiner Betätigung für diese Verbindung in einer Justizvollzugsanstalt zum Gegenstand hat, ist nicht zur Entscheidung anzunehmen, weil die Annahmevoraussetzungen nach § 93a Abs. 2 BVerfGG nicht vorliegen.

2 Weder kommt der Verfassungsbeschwerde grundsätzliche Bedeutung zu (§ 93a Abs. 2 Buchstabe a BVerfGG) noch ist ihre Annahme zur Durchsetzung der in § 90 Abs. 1 BVerfGG genannten Rechte des Beschwerdeführers angezeigt (§ 93a Abs. 2 Buchstabe b BVerfGG). Die Verfassungsbeschwerde hat keine Aussicht auf Erfolg.

3 Unbeschadet der Frage, ob sich Vereinigungen von Gefangenen, die sich als Gewerkschaft bezeichnen, und deren Mitglieder auf die Koalitionsfreiheit aus Art. 9 Abs. 3 GG berufen können, ist die Verfassungsbeschwerde offensichtlich unzulässig, weil sie nicht den gesetzlichen Bestimmungen der § 23 Abs. 1 Satz 2 Halbsatz 1, § 92 BVerfGG entsprechend begründet ist. Der Beschwerdeführer hat nicht in ausreichendem Maß dargelegt, welchen konkreten Maßnahmen der Justizvollzugsanstalt er unterlegen hat und welche gewerkschaftlichen Aktivitäten im Einzelnen hierdurch behindert worden sind. Gänzlich unterlassen hat der Beschwerdeführer Ausführungen zur Rechtswegerschöpfung oder zu deren ausnahmsweiser Entbehrlichkeit im Sinne von § 90 Abs. 2 Satz 1 BVerfGG sowie zur Wahrung der Monatsfrist nach § 93 Abs. 1 BVerfGG.

4 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

5 Mit der Nichtannahme wird der Eilantrag gegenstandslos (§ 40 Abs. 3 GOBVerfG).

6 Diese Entscheidung ist unanfechtbar.
