The Federal Constitutional Court did not admit the constitutional complaint. It held that the filing was manifestly out of time because an inadmissible legal remedy, later withdrawn after judicial warning, does not suspend or extend the one-month complaint period. The complaint was also inadmissible because the complainant had not exhausted legal remedies, in particular by filing an Anhörungsrüge under § 78a ArbGG. In addition, the submission failed to meet the statutory substantiation requirements. The Court therefore dispensed with further reasoning and the decision is final.

Die Erhebung eines von vornherein unstatthaften Rechtsbehelfs, der nach richterlichem Hinweis zurückgenommen wird, hindert den Ablauf der Monatsfrist des § 93 Abs. 1 S. 1 BVerfGG nicht. Die Verfassungsbeschwerde ist ferner nur zulässig, wenn der fachgerichtliche Rechtsweg vollständig erschöpft ist; hierzu gehört grundsätzlich auch die Erhebung einer statthaften Anhörungsrüge, sofern diese eröffnet ist. Schließlich muss die Beschwerde den Darlegungsanforderungen der §§ 23 Abs. 1 S. 2 Halbs. 1, 92 BVerfGG genügen; fehlt es daran in substantiierter Weise, ist sie unzulässig.

Gründe

1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen (§ 93a Abs. 2 BVerfGG), denn sie ist unzulässig. Zum einen wahrt sie ganz offensichtlich nicht die Beschwerdefrist (§ 93 Abs. 1 BVerfGG), denn die Erhebung eines Rechtsbehelfs, der nach richterlichem Hinweis auf seine Unstatthaftigkeit zurückgenommen wird, verlängert nicht den Lauf der Beschwerdefrist. Ferner ist mangels Erhebung einer Anhörungsrüge nach § 78a ArbGG auch der Rechtsweg nicht erschöpft (§ 90 Abs. 2 BVerfGG). Schließlich genügt die Verfassungsbeschwerde nicht im Ansatz den Substantiierungsanforderungen der § 23 Abs. 1 Satz 2 Halbsatz 1, § 92 BVerfGG.

2 Von einer weiteren Begründung wird gemäß § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

3 Diese Entscheidung ist unanfechtbar.
