The First Chamber of the First Senate of the Federal Constitutional Court did not accept the constitutional complaint for decision. It referred to its reasoning in the parallel case 1 BvR 1932/08 and, pursuant to § 93d(1) sentence 3 BVerfGG, provided no further reasons. The decision is final and not subject to appeal.
§ 93d Abs. 1 Satz 3 BVerfGG; non-admission of a constitutional complaint by chamber decision. Where the Chamber relies on the reasons stated in a parallel decision and sees no need for further explanation, it may dispense with additional reasoning. The non-admission leaves the challenged lower-court judgments in place and is not subject to appeal.
