The Federal Constitutional Court did not accept a constitutional complaint against a criminal warning imposed for conducting an unannounced assembly. The Regional Court of Münster did not rely solely on the fact that the assembly was notified to an incompetent authority, but also on the absence of any concrete basis for assuming that the notification would be forwarded to the competent authority. Gründe

1 Die angegriffenen Entscheidungen halten sich im fachgerichtlichen Wertungsrahmen. Das Landgericht stützt die Verwarnung des Beschwerdeführers nicht schon für sich tragend darauf, dass dieser die von ihm veranstaltete Versammlung bei der unzuständigen Behörde angezeigt hat. Vielmehr stellt es maßgeblich auch darauf ab, dass keine hinreichenden Umstände ersichtlich seien, auf die der Beschwerdeführer die Annahme hätte stützen können, die Anmeldung werde an die zuständige Versammlungsbehörde weitergeleitet. Diese Würdigung ist vertretbar.
