Résumé Omnilex

The Second Chamber of the Second Senate of the Federal Constitutional Court declined to admit the constitutional complaint. It held that, insofar as the complainant relied on an alleged violation of the European Convention on Human Rights, the legal remedies had not been properly exhausted. The decision was issued as an unreasoned chamber order and is final.

Regeste Omnilex

§ 90 Abs. 2 S. 1 BVerfGG; a constitutional complaint is inadmissible insofar as the complainant invokes an alleged violation of the European Convention on Human Rights without having properly exhausted the ordinary legal remedies in respect of that contention (cf. BVerfGE 112, 50 <62>; 129, 78 <93>). In such a case, non-admission may be ordered by chamber under § 93d Abs. 1 S. 3 BVerfGG without reasons.

Question juridique clé

Whether the constitutional complaint was admissible despite the complainant's reliance on an alleged ECHR violation.

Solution extraite

The complaint was not admitted because the complainant had not properly exhausted the legal remedies with respect to the ECHR-based argument.

Motifs extraits

The Court held that a claimed violation of the European Convention on Human Rights must be raised through the ordinary courts before it can support a constitutional complaint; that was not done here.
