BVerfG 2 BvR 2628/10 ΓÇó Repeat interim suspension of prison sentences
BVerfG 2 BvR 2628/10Bverfg / 2e division22 oct. 2012Granted
In the constitutional complaint proceedings, the Federal Constitutional Court repeated its interim order of 22 May 2012. The execution of the prison sentences remains suspended for six months, but no longer than until the constitutional complaint is decided.
§ 32 Abs. 1 BVerfGG; repeatability and temporal limitation of an interim order: where the prerequisites for urgent relief continue to exist, the Federal Constitutional Court may repeat an interim measure, but it must remain strictly limited in time and may be ordered only until the main proceedings are decided. The order is confined to provisional relief and does not prejudge the merits of the constitutional complaint.
